Throughout the years there has. been multiple cases of domestic violence all around the world. Domestic violence can be seen as multiple things whether its physical, emotional, verbal, sexual, technological or economical abuse. Throughout the years women, children and men go through domestic abuse on a daily basis, and may or may not know anyone or any resources that might help or know any that are available. Domestic Violence can start from something so small and escalate to something worst over time. In an article form the Emory University School of Medicine: Domestic violence/ intimate partner violence they state, domestic violence affects roughly around 1 in 3 women and 1 in 4 men and 1 in 15 children. Worldwide about 25% of women experience any type of abuse during their lifetime, while 13% of men experience any type of domestic violence during their lifetime. Overall, there is many domestic violence cases and so many resources available online. But domestic violence should be seen as a federal crime instead of being seen as a misdemeanor. This should not be seen as a misdemeanor and more towards a federal crime charge because of all the trauma and the stress level that the victim is going through. Another reason this should be considered a federal crime instead of a misdemeanor is because of what might not even lead to only a domestic violence charge but could end up worst.
All over the world there is someone known or unknown going through domestic violence. There are many sources that help women like, The violence against women act (VAWA). In an article written by Jeelani Law Firm: Understanding domestic violence charges, they explain how the VAWA system works and when the act was passed. In 1994 the act was passed and what the qualifications are to the act are, physical abuse/ assault, sexual abuse, verbal threats, emotional abuse, stalking/ cyberstalking. These can only lead for a misdemeanor that can cause up to 1 year in county jail, fines, probation and mandatory domestic violence or anger management classes. In another article by Tara Law, the violence against women act was signed 25 years ago: Here's how the law changed American culture, she states how back in 1994, domestic abusers could avoid being prosecuted for beating their spouse's by crossing the states borderline and they couldn't get charged in other states and police officers were discouraged to get involved. Also stated by Tara Law, due to the violence against women act there has been a dramatic decrease in domestic violence in the United States. Domestic violence has always been something women, children, men don't always want to talk about because they fear what might happen if they speak up about their abuse and their abuser. With the VAWA their is a lot of resources that are helpful to any victim of any type of domestic abuse. In another article written Kaitlin N. Sidorsky and Wendy , J Schiller: Can government protect women from domestic violence, they state after 1994 2 years later after the VAWA act they passed another amendment called Lautenberg which basically prevents a domestic abuser or someone who has a record of domestic violence purchase a gun.
There is a lot of ways domestic violence is seen or even known. With there being multiple ways like stated in a source by Jeelani Law Firm: Understanding domestic violence charges, physical abuse meaning doing any type of physical with an individual by either slapping or pushing them ect. Sexual abuse meaning having any non-consensual sexual activity or anything that the individual does not want to do. Emotional abuse meaning targeting anything about a person's confidence or self-worth, this can also apply to constant criticism and undermining one's ability. Financial abuse meaning controlling you're partners control over their money and resources, stealing or using their legal powers. The last 2 are physiological abuse and technological abuse. Phycological abuse is a person who tries to instill fear or isolate the victim, this also involves making threats to harm their victim. Technological abuse, using digital tool to harras, stalk, hack accounts or use their social media apps to intimidate or pretend to be someone else. All of these are considered to be different way of domestic abuse, yet the only type of charge a person can get is a misdemeanor. In an article by Perlet and Shiner: Is Domestic violence ever charged as a federal crime, they state how only going as far as kidnapping, sexual assault or false imprisonment among others, these are the only way attorneys can prosecute the cases to aggressively simplify domestic violence.
All around the world there is multiple cases of domestic violence that no one talks about. Throughout the years multiple cases have been reported of domestic violence. In an article by Kaitlin N, Sikorksy and Wendy J, Schiller: Can government protect women from domestic violence, they state a case in Michigan from 2022. Her name was Tirany Savage she had filled for a protective order from her husband, she asked if they could remove her husband from her home due to mental health issues after he had stopped taking his medication. Prior to that he had bought a firearm, which made her feel concern for her safety. She had rapidly gone to the court to let them know what was going on, telling them what her husband had said Quote " He would blow his brains out" due to this she was scared for her safety and also her child's. After the women requested for a DVRO ( domestic violence restricting order) and the judge denied her order and instead of helping her he send her to a divorce lawyer. Just a few days later Tirany Savage, her mother, and her 13-year-old son were shot. to death by her husband who then later shot himself. Due to all this, something that could of been prevented if only the judge had listened to her and gave her the protection she needed she would of been alive, due to the domestic violence that some people don't take seriously. After this the law passed that like stated in the article nearly 30 years ago, they passed a law that no one with Dv charges can possess a firearm. In another article by Gary Coronado: Children keep dying: Why can't LA protect them, he starts by talking about the very popular domestic violence case of the killings of 3 boys. Noah Cuatro, July 11 2019 he was going through domestic abuse at home later died due to lack of movement and not get removed from his home. Anthony Avalos, July 2nd 2018 he was also going through domestic violence at home at the age of 10 for coming out as gay. Gabriel Fernandez May 24 2013, He was 8 years old was found deadly beaten the paramedics found him with a broken skull, three broken ribs and bb pellets. With all of these cases all children were put through because of Dcfs because of domestic abuse yet none of their parents were ever charged for a federal crime or for domestic abuse. After all they got charged for murder if anything because of the lost of these 3 children, because of this they should have been charged for domestic violence as a federal charge before any of this could of happened.
With all of the women/children/men who go through domestic violence and don't make it out there is that percent of people who do. In an article by Jada, Kim, Bechtel, Kristin, Pawes, Debbie, Demichele, Mathew: Exploring the relationships of domestic violence charges on release and detention decisions, they all talk about domestic violence survivors and how their experiences were and what the outcome was. They also talk about how they did not experience justice when their cases were processed the criminal legal system and how their partners were unlikely to take any responsibilities for the harm they caused. Meaning they got to walk free, the max they could have possibly gotten would be a misdemeanor but others might also agree that it should be considered a federal crime because of all the things like physical abuse and mental abuse that were caused by that individual. Also mentioning that just because they walk free doesn't mean they won't have someone else to do it back to or start something.
Overall, with everything said about domestic violence and how some people tend to oversee it because of the abuse might be verbal, that does not mean it should not be taken serious. With all the domestic cases all over the world there will always be someone going through it at the daily whether its kids/women/men, they don't get their justice they tend to just let the person who broke them with all the domestic abuse walk around free. Even if they do see them get any justice they would probably end up doing 1 year in county jail with a misdemeanor in their record. But like stated it should be considered a federal crime, with all the causes that came from the domestic abuse all the time that was taken from the person that they can't get back. So making domestic abuse a federal crime and actually making it a big deal should be considered.
